  • Court is pretty damn interesting.

    So I was on the witness stand for an hour yesterday. I'm the balls. A lawyer even said I should be a professional witness, whatever the fuck that means. IF I get paod for it, I'll do it.

    The opposition lawyer (there are actually three sides to this case, I am actually on two sides at once as a key witness for the plaintiff and also as a 3rd party defendent) tried to pull some stupid shit on me, but I bitch slapped him with my words. I'm the balls I tell you.

    Two truck drivers are on the jury, too. One retired, one current. Hopefully that works in my favor. The stupid ass opposition lawyer tried to make it look like I wasn't the best driver......BULLSHIT! I have two speeding tickets and no at fault accidents in 8 years of driving, that is damn good actually.

    Then he tried to impeach me on my deposition from a year and a half ago. But nope, the little fucker failed there too.

    Anyways, more when I get home I think. Hopefully this shit works out.

        I was happy. Now I want to be a Canadian.

        Fuck this country's stupid ass laws, and stupid ass jurors.

        Shit sucks now. I may or may not come home tonight. I don't know. If I don't I will still be home in time tomorrow to run the stage for tomorrow.

                Ok, court ended up sucking bad. Technically, as 3rd party defendents, my wife and I won our part. But the plaintiff, my mother-in-law, got screwed over in the process. There are things that couldn't be said, or talked about int he case that could have had an impact. Namely insurance, insurance comanies, anything to do with the word 'insurance' was off limits. I don't totally understand it, but that is the way things are in this country I guess, or state, whatever it is.

                Anyways, last night was just crap. I didn't want to drive home, nobody else really wanted to either. The hotel room was free so we figured screw it. It sucks when you look people in the face (the jury) and tell them the truth, and then they don't buy what you say. They could have all slapped me and it would have had the same effect to me. Anyways, I will talk more later. I got shit to catch up on still.

                  the insurance bias issue. The mention of insurance taints the jury because they then decide that the person with insurance should pay because it doesnt really effect any real party in the room.

                    I understand the rule, I just think in certian cases it is taken too far. All parties here had insurance for instance. Also, my mother-in-law couldn't say how she had seeked treatment from a doctor right away, but was rejected because it wasn't an emergency and because it was from an auto accident in which she wasn't at fault. I don't understand why the doctor did that really, but he did, and it couldn't be talked about in court. So it looked like she didn't go in for any kind of treatment.

                    But my big problem was with the jurors. My wife and I show up at court, the other guy doesn't. The other guys deposition is read for him, in which stupid things are said, like I am hispanic, like that my wife was driving, and other stuff. I love the part where he couldn't see our Blazer at any point before the accident, yet says he knows my wife was driving and that we switched drivers even though he never saw it. So much of his story differs from ours, I mean complete 180 from ours. The guy lied his ass off basically.

                    And the jury believed part of his story somehow. I don't get it at all. So Question 1 for the jurors was to place blame, on him, my wife, our myself. They said no one was at fault. That made the rest of the questions obsolete and they never even had to decide about my mother-in-laws stuff since they said no one was to blame.

                    Since I said that part I will tell what happened now I guess....

                    This was 4 years ago. Coming back from Houston we saw a vehicle on the side of US59, on fire. I pulled over to help. Right after I pulled up a 1 ton flatbed pulled in front of us. I decided to back up, to get a little distance between myself and the fire. He decided to do the same I guess, no big deal right? Well, when I was stopped again, and in park about to get out, he was backing at full speed and wasn't stopping. He smacked into us, messed up my car some, and my mother-in-law hurt her shoulder.

                    The other guys story.....My wife was driving, and drove forward into the back of him.

                    Yet, even though he says we drove forward into him, rear-ending him, the defense attorney also says "But even if he did back into them he isn't at fault because he felt he was in immediate danger from the car fire."

                    How the hell can you have it both ways? Somehow the jury agreed though. They let the defendent off. :roll:

                    For some reason my wife and I weren't believed. That fire wasn't that bad, and it never exploded like he said. The guy lied in so many areas it drives me nuts.

                        Yeah that was the car we just sold. His insurance company paid to have it fixed, paid for a rental car for us for two weeks, and paid a little on some other shit. But he did nothing wrong I guess. Oh, and the police report, after the officer talked to both of us, showed that he was at fault 100% and he was ticketed for backing without safety. I don't know if he admitted it to the cop, but he admitted it was his fault to me (although he told the court he never talked to me, and that I didn't speak english even though he shouldn't have known if I did or didn't since he didn't talk to me eh?).

                        Oh, and speaking of good deeds, it was weird going up there. We had to go to Houston first to meet with a lawyer (Wharton is were the trial was, farmer country an hour south of Houston). We hit a spot of rain and had a car spin out on an overpass right in front of us. They were up against the hammer lane wall facing south on the north bound side. So I stopped to check on them, my wife called 911. I was just praying nothing happened to my van because that would have been fucked up. :lol:

                        We also had a nice trip home Wed. morning. Had a pickup lose a pallet from it's bed right in front of me, so I had to swerve to avoid that. Came up on an accident right after it happened (enough people had already stopped though so I kept going). It was just a mess.

                              that was good shit. count your blessings. and you are right about it sucking the way it played out. not sure why the doc turned you away just because accident. odd stuff.

                              on a side note i didnt know that guys who couldnt speak english could type it.
